Warranty Terms & Conditions

The terms and conditions of this warranty are subject to change by Atom Operation (Pty) Ltd (“ATOM”) without notice, provided that the terms and conditions in effect, as of the date of purchase of the device, shall apply to that device.




1. The Warranty Covers 


Atom warrants the device against defects in material or workmanship under normal use from the date of original purchase by the customer. If the device becomes defective during the warranty period, Atom will, at its option and without charge, repair the device with new or used components or parts, or replace them with a reconditioned device of the same or functionally equivalent model. Shipping costs of the defected device to the Atom repair centre is to be covered by the customer.


2. The Warranty Does Not Cover


This warranty does not cover defects caused by the operation of the device outside the usage parameters stated in the device documentation, unreliable communication from devices due to factors beyond our control and shall include, but shall not be limited to, malfunctions caused by misuse or abuse, accidental drops, impact, liquid spills, by improper installation, operation or maintenance, by improper connections or peripherals, by use of non-Atom spare parts, by service modifications or repairs performed by a person not authorised by Atom to do so, or by other conditions not arising from defects in device materials or workmanship. Atom is not responsible for damage to or loss of any programs, data, whether it occurs in or out of warranty. The warranty does also not include dissatisfaction due to buyer’s remorse, normal wear and tear, damages incurred during transportation and damages incurred during assembly or maintenance. 



3. Return to Atom Repair Centre


Atom offers a purchaser a return to repair centre service for the applicable warranty period which includes repair of all defects in materials and workmanship (i.e., labour and parts therefore); provided that the fault has occurred under the normal operation of the device detailed in the device documentation. Parts removed from a device during the warranty service will become the property of Atom. The device shall be deemed to be repaired when it passes tests performed according to the original device specifications.



4. Data Storage Media


The customer must regularly back up that data. Atom and its subsidiaries, affiliates, suppliers, service providers, and resellers shall not be responsible for any software programs, data or other information stored or used on any media or part of any device returned to Atom or its solutions providers for warranty or other repairs, including but not limited to the costs of recovering such programs, data, or other information. 


5. Warranty Limitations


This warranty, in lieu of all conditions and warranties, express, implied, or statutory, including but not limited to any implied conditions or warranties of merchantability, merchantable quality, or fitness for a particular purpose by Atom and its subsidiaries, affiliates, suppliers, solution providers, and resellers. All implied or statutory conditions and warranties to the extent that they cannot be excluded are limited as set forth herein. Except to the extent prohibited by applicable law, Atom and its subsidiaries, affiliates, suppliers, solution providers, and resellers shall not be liable for any damages including, but not limited to, indirect, incidental or consequential damages, loss of use or data, loss of profits, or Interruption of business, regardless of whether such alleged damages are based on the warranty hereunder, tort, or contract (even in the nature of breach of fundamental term). This warranty does not cover any device (a) that has been the subject of accident, misuse, neglect, or abuse; (b) that has been the subject of improper installation, use or handling; (c) that has been repaired, modified, or altered by someone other than Atom or an authorised service provider, or (d) that has been exposed to operating or environmental conditions in excess of Atom’s written specifications or recommendations. This warranty does not cover scratches or abrasions to the device, including damage caused by the use of any instrument not specifically designed for use with the device.



6. Warranty Period


  1. 1 year for manufacturing defects such as cracks on the enclosure, faulty boards,
  2. A battery is a consumable item and after a period of normal use or over time, the battery's ability to hold an electrical charge will be diminished. A battery that has reduced capacity or has failed because it has been consumed via normal use or over time is not covered under warranty. The battery is only warranted during the warranty period (or declared lifespan by the manufacturer) for,
  3. 2 years if the battery fails within 2 years,
  4. If the battery fails in the 3rd year, it can be replaced and the customer will be charged the cost price for the replacement,
  5. If the battery fails in the 4th year or beyond, the customer will be charged the retail price for the replacement.


7. Repair Service


If a device has a factory fault the customer must log a service request with the Atom Service Desk. Atom will contact the customer to enquire as to the extent of damage or failure. Depending on the cause and extent of the damage, Atom will initiate the repair process. Once the device’s serial number has been provided, an Atom technician will provide instructions for returning the device to the Atom repair facility for repair. It is suggested that the customer carry spare devices to replace the damaged device while it is being repaired.


The following repair conditions apply:

  1. Claims for defective devices must be made within ONE year from invoice date. Claims for missing parts must be made within 60 calendar days after the merchandise is received,
  2. Any claim for defective merchandise returns must be packed in original packaging,
  3. We reserve the right to specify that items be returned to the original warehouse for inspection or be inspected by our representative in the field,
  4. Pictures are required to claim defective merchandise, along with a copy of the original invoice,
  5. If the claim is justified, the item(s) or part(s) will be repaired or replaced, or a credit will be issued,
  6. Shipping and handling fees are to be paid for by the customer.
